PRICING: Prices are subject to change without notice. All written quotes will be valid for 30 days from the quotation date unless otherwise specified. All prices are in U.S. currency.
DEFECTIVE OR DAMAGED PRODUCTS: Per Vivo Labs® carefully inspects all products prior to shipment. Any product deemed to be defective is covered by PVL’s Limited Warranty (see “Limited Warranty”). Within 24 hours of acceptance, any product deemed to be damaged will be replaced at no cost. Within 24 hours of accepting a damaged product, customers should contact PVL Customer Support at (423) 765-4007 ext. 2 or firstname.lastname@example.org. Please have available/include the order number, purchase order number, or invoice number. Within 48 hours of notification, PVL will ship an exact replacement of the damaged product and a return shipping label to the customer. Customers can pack the damaged product in the same box used to ship their replacement, and then either bring the box to their nearest FedEx location, or coordinate with PVL Customer Support for pickup.
LIMITED WARRANTY: All of PVL’s products come with a 60 month limited warranty that begins on the day a shipment is accepted. This warranty is for the original owner with proof of purchase. Products must be used for their intended purpose and cared for in accordance with recommended procedures. PVL is not responsible for punctures, tears, ruptures, or any other damages or deficiencies caused by improper storage, transport, or use. Any product that fails to maintain its original condition as a result of a manufacturing defect within the 60 month warranty period will be replaced at no cost. This warranty is limited to repair or replacement. Customers in possession of a defective product should contact PVL Customer Support at (423) 765-4007 x2 or email@example.com. Within 48 hours of notification, PVL will ship an exact replacement of the damaged product and a return shipping label to the customer. Customers can pack the damaged product in the same box used to ship their replacement, and then either bring the box to their nearest FedEx location, or coordinate with PVL Customer Support for pickup.
THIRD PARTY DISTRIBUTORS: Third party distributors have 14 days from the date of receipt of a damaged or defective product from the customer to return said product to PVL. Any returns will result in PVL crediting the respective distributor’s account in the amount of the price originally paid by the distributor for the product. In the case of a terminated agreement, PVL will issue a check to the third party distributor in the amount originally paid by the third party distributor for the returned products.
GENERAL RETURNS: In the event customers want to return a product for reasons other than damage or defect, customers have 14 days from the date of acceptance to notify Per Vivo Labs (PVL) Customer Support at (423) 765-4007 ext. 2 or firstname.lastname@example.org. Be advised that customers will need to meet the requirements specified under “Eligibility for Return.” A 15% restocking fee will be charged for returns requested within 14 days of the invoice date. Customers will be responsible for all return shipping costs.
ELIGIBILITY FOR RETURN: Products must be in the customer’s possession for 14 days or less, in new, resalable condition, and in the original, unopened packaging.
INELIGIBLE ITEMS FOR RETURN: Items that are: sterile, opened, expired, in the customers possession for more than 14 days, discontinued, special order, customized, or the integrity is compromised.
SHIPPING: PVL reserves the right to determine the best method of transportation for each order. Orders shipping to an APO or FPO address will ship U.S. Mail if the product is within the postal requirements. Otherwise, a physical stateside address will be required to complete the shipment.
CLAIMS: In the rare event you receive a damaged package you may file a claim directly with the carrier. All claims must be reported immediately to PVL Customer Support. Please retain all original packaging and documentation for the carrier to review if necessary.
RESALE INVENTORY: Items purchased for resale are available for distribution within the US only. Written permission from PVL is required to export. Unauthorized exporting of products may be cause for account closure.
CREDIT POLICY: U.S. Federal Agencies and Municipalities are prequalified for Net 30 payment terms. All other customers may fill out a new account application for credit review. PVL reserves the right to assign one of the following terms: Pre-Paid, Net 30, or Credit Card. An account supported by a line of credit will receive a 2% late charge per month for past due invoices. Customers located outside of the United States will default to Pre-Paid terms. Any account that becomes delinquent may default to Pre-Paid terms or be placed on permanent hold status. PVL reserves the right to accept or reject any order at any time.
INTELLECTUAL PROPERTY: PVL™, Per Vivo Labs®, and the Polar Skin™ Family of Products are all trademarks of Per Vivo Labs, Inc. Intellectual Property infringement: All materials contained on websites operated by Per Vivo Labs (www.pervivolabs.com/www.heatstrokehelp.com) are protected by international trademark and copyright laws and must only be used for personal, non-commercial purposes. The unauthorized reproduction or distribution of material from these websites is STRICTLY PROHIBITED unless you have obtained the prior written consent of Per Vivo Labs, Inc. The material covered by this prohibition includes, without limitation, any text, graphics, logos, photographs, audio or video material, or still images from audiovisual material available on these websites. The unauthorized reproduction or distribution of these copyrighted works is illegal. Criminal copyright infringement, including infringement without monetary gain, is investigated by the FBI and is punishable by up to five years in federal prison and a fine of $250,000. In a civil action, a willful infringer is liable for statutory damages of $150,000 for a single work, or actual damages at the copyright owner’s election.
TERMINATION: These terms and conditions are applicable to anyone accessing PVL’s websites, completing the registration or shopping process, and/or placing any order via phone, email, or fax. These terms and conditions, or any part of them, may be terminated by Per Vivo Labs, Inc., without notice at any time, for any reason. The provisions relating to Copyrights & Trademarks, Conditions, Customer Warranty; Liabilities and Indemnification, shall survive any termination.
